Family Law Questions, Answered
Here are answers to the questions we hear most often from DuPage County families. If you have a question we have not covered, please call us at 630-529-6600.
How long does a divorce take in Illinois?
It depends. An uncontested divorce can resolve in a few months. A contested divorce with custody and property disputes may take a year or longer. We give honest timing estimates after we understand your case.
Do I have to go to court for divorce in DuPage County?
Most divorces are resolved through settlement, with a brief prove-up hearing at the end. If your case cannot be settled, we are prepared to take it to trial.
How is child support calculated in Illinois?
Illinois uses an income shares model based on both parents’ net incomes, the number of children, parenting time, and certain expenses such as health insurance and daycare.
What is allocation of parental responsibilities?
It is Illinois’s term for what used to be called custody. It covers decision-making authority (legal custody) and parenting time (visitation), and is based on the best interests of the child.
Do I need a will if I am not wealthy?
Yes. A simple will tells Illinois who inherits your property and who should care for your children. Without one, the state decides. A few simple documents protect your family.
